No, never.

It would probably not be dealt with as a privacy issue but as a workplace
surveillance issue. This Act is a fairly new one that some employers still
ignore to their peril ("too hard"). Its requirements need to be followed
before the event, not after.

IMHO every employer should have a copy of this Act, a variety of
supporting explanatory documentation to help (google, employer
organisations and/or unions), at least one HR person who fully understands
its requirements, and if at all possible on-going access to a lawyer or
industry advisor for any tough questions.
